Man Faces Domestic Violence Charges After Injured Woman Seeks Help At Palm Beach International Airport

It makes for a dramatic story when an injured person suddenly appears, apparently the victim of an attack, and everyone else must figure out how it happened.  Reconstructing events with enough certainty to convict a defendant of the attack in criminal court is not as simple as it seems, though.  Case in point, earlier this year, a woman approached the ticket counter at Palm Beach International Airport and asked to buy a ticket to travel to the city where her parents live.  She had visible facial injuries consistent with an assault, and she suffered a seizure while in the airport.  A domestic violence investigation began in earnest after she received treatment at a nearby hospital.  The woman’s estranged husband is now facing charges for assault, and the court set his bail amount at $90,000 after his arrest, but it is far from certain that he will be convicted.  If you are facing charges for domestic violence, and these charges did not arise from your spouse or partner calling the police in the middle of a heated argument, contact a Tampa domestic violence lawyer.

Casting Doubt on Allegations of Domestic Violence When There Are No Eyewitnesses Except the Accuser

The testimony of the accuser is often the centerpiece of the prosecution’s case in domestic violence trials; in fact, the reason that so few domestic violence arrests result in criminal convictions is because the accuser refuses to testify, and without his or her testimony, the prosecution does not have enough evidence to convict, so the court must drop the charges before the case gets to trial.  Meanwhile, it is often possible for the defense to establish reasonable doubt about the veracity of accuracy of the accuser’s testimony.  For example, on cross examination, the defense attorney may find contradictions or inconsistencies in the accuser’s account.  Likewise, the defense may be able to show that the accuser has ulterior motives.  This happened in a case where the defendant had signed a prenuptial agreement whereby his wife was entitled to alimony if the couple divorced because of domestic violence but not if they divorced for any other reason.

Evidence from outside sources can corroborate the accuser’s testimony, or it can cast doubt on it.  In the present case, the testimony of the ticket agents and other witnesses at the airport may strengthen the prosecution’s case against the defendant.  During the pretrial phase, the defense might even find a reason to summon the people who saw the accuser at the airport as witnesses to show how the defendant was probably not the one who caused her injuries.  Likewise, the accuser’s medical records from before and during the emergency room visit may determine the outcome of the case.
